1.Rental Rates The Rates quoted is in Ringgit Malaysia (RM) and is subject to change without prior notice. The Rental Rates are for a minimum of 24 hours rental. 2.Deposit The Hirer is required to place cash deposit as guarantee for due compliance of the Hirer's duty as stated herein and the proper use of the Vehicle for the entire duration of the hired period, the Deposit will be reimbursed if no damage is caused to the Vehicle and no breach of the terms to be observed by the Hirer. 3.No refund for Unused Services No refunds will be made for the unused Rental. For cancellation of booking, payment made shall be forfeited. 4.Driving License The Hirer must be in possession of a valid driving licence and an international driving license for non-citizen of Malaysia. 5.Return of Vehicle At the expiration or termination of the hired period, the Hirer shall remove at his own cost all accessories (if any) affixed by the Hirer and it shall deliver the Vehicle to the Company at such address as stated in the contract, in good order, repair and condition (with fair wear and tear resulting from the proper use thereof expected) failing which the Hirer shall be liable to reimburse the Company on demand for all costs of restoring the Vehicle to such good order and condition. 6.Petrol, Parking, Toll and Traffic Fines Petrol, parking, toll fees, traffic fines and miscellaneous charges are the responsibilities of the Hirer. An additional administration fees of RM100-00 will be charged to the Hirer in addition to any traffic fine for violation arising during the hired period. 7.Collision Damage Reduction (CDR) Collision Damage Reduction is provided to the Hirer with option subject to payment of fees as provided herein below:- Vehicle Group A B Excess on Accident RM1,000-00 Excess on Theft RM3,000-00 CDR Fee RM20-00 per day Reduced Excess Amount RM500-00 ? EXCLUSION CLAUSE : However CDR will only be effective subject to availability of a police report and acceptance by the Insurance company as provided in the policy. CDR coverage does not cover inter alia missing items or accessories or damage caused by negligent and reckless driving, or driving in violation of the terms hereof or driving while under the influence of alcohol or drugs and in such cases the Hirer shall be fully responsible for the damage to the Vehicle and shall reimburse the Company for loss for business. NOTE : THE CDR is very much depends on the insurance company it is better to let your agent to brief you and get the schedule and exclusion clause from your agent. The schedule provided above is only for illustration. 8. Accident In case of accidents involving the vehicle, the Hirer shall:- (a) Obtain the names, identity card numbers, address and driving license number of the parties involved and of the witnesses; (b) Not abandoning the vehicle without adequate provisions for safeguarding tan securing the same; (c) Notify the Company immediately and complete the Motor Accident Report Form as required by the insurance company and to provide all assistance in any litigation or investigation relating to such damage or accident; (d) Lodge a police report within 24 hours and supply such information, drawings and assistance in connection as the police may require; 9.Emergency Service In any emergency situation such as breakdown, the Hirer must contact the Company at the emergency line provided. 10.Replacement If the Vehicle booked by the Hirer prior to commencement of the hired period is not available, the Company shall have the right to replace the same with an alternative Vehicle of similar seating capacity. Should the Hirer decide not toaccept the alternative, all monies paid by the Hirer will be refunded in full without further obligation or liability on the part of the Company. 11.Insurance Coverage (a) The vehicle is insured under a standard motor vehicle insurance policy in accordance with legislation governing the use of the vehicle in Malaysia covering the liability of the Hirer and authorised operator in respect of third party injury or death and passenger risk liability. The Hirer agrees to be bound by the terms and condition of the said policy ,a copy of which is available for inspection upon request. (b) However personal accident coverage for both passenger and driver can be extended upon request with payment of additional premium. 12.No liability The Company is not responsible for loss or damage to any property left, stored, loaded or transported by the Hirer. 13.Disclaimer The Company makes no warranty of any kind in any nature or description expressed or implied as to the merchantability of fitness for any particular purpose of the Vehicle. The Hirer shall not make any claim against the Company for damages for delay due to the breakdown or accident involving the vehicle and shall indemnify the Company for all damages payable by the Company as a result of such claims. 14.Use of the Vehicle The Vehicle shall not be used:- (a) By any other person other than the Hirer or authorised operator; (b) In breach of any of the terms hereof ; (c) To carry passengers or property for hire; (d) To tow any vehicle, trailer or other object; (e) To participate in any race, test or contest; (f) For any illegal purposes; (g) To carry passengers in other than the passenger compartment of the Vehicle; (h) In any manner whereby the vehicle will be loaded beyond its rated/permitted capacity; 15.Indemnity The Hirer shall indemnify and hold harmless the Company from and against all loss liability, costs and expense sustained or incurred by the Company from the acts or permission of the Hirer and arising from the violation by the Hirer of the term herein or the laws of Malaysia. 16.Law This Agreement shall be governed by and construed in accordance with the laws of Malaysia and the parties shall submit to the Courts of Malaysia in the event of nay dispute or difference between them.
